1. Acceptance of terms
These Terms of Service (“Terms”) are entered into between you and Blood Health AI LLC, a Georgia limited liability company with offices at 406 E 3rd Ave, San Mateo, CA 94401, USA (“Blood Health AI,” “we,” “us”). They govern your access to and use of the Blood Health AI website and mobile application (collectively, the “Services”). By creating an account or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
2. Description of services
Blood Health AI provides a consumer wellness mobile application and informational content. The app helps you log everyday wellness signals (such as self-recorded blood pressure readings, meals, sleep, and activity) and presents them as easy-to-understand trends and general wellness suggestions. A companion device is in development; it is not currently offered for sale.
3. Not medical advice
Critical disclaimer: Blood Health AI is a general wellness and informational tool, not a medical device, healthcare provider, or substitute for professional medical care. Our content is educational and informational in nature. It does not diagnose, treat, cure, or prevent any disease or medical condition. Always consult a qualified healthcare professional before making medical decisions or changing your diet, exercise, or medication. If you are experiencing a medical emergency, call 911 or your local emergency number immediately.
The app may surface general wellness suggestions based on the information you log. These suggestions are not a diagnosis and should not be used as a basis for clinical decisions.
4. Eligibility
The Services are not directed to children. You must be at least 16 years old to use the Services (and at least 13 if you reside in the United States, where additional restrictions apply under COPPA). By using the Services, you represent that you meet the applicable age requirement and that the information you provide is accurate and complete.
5. User accounts & responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or security breach. You may not share your account with others or transfer it to another person.
6. Acceptable use
You agree to use the Services only for lawful purposes and in accordance with these Terms. Prohibited conduct includes:
- Using the Services for anyone other than yourself without explicit authorization.
- Attempting to reverse-engineer, decompile, or tamper with our hardware, firmware, or software.
- Uploading malicious code, interfering with our systems, or conducting unauthorized automated access.
- Providing false or misleading health data that could affect algorithm outputs.
7. Intellectual property
All content, software, designs, algorithms, and branding on the Services are the property of Blood Health AI or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, distribute, or create derivative works without our written permission.
8. Purchases
We do not currently sell hardware or paid subscriptions through this website. If we begin offering paid products or services in the future, applicable pricing, taxes, shipping, refund/return policies, warranty terms, and (for EU consumers) the statutory right of withdrawal will be presented before checkout and will form part of these Terms by reference.
8a. SMS / text messaging program (A2P 10DLC)
Blood Health AI operates an opt-in SMS / text messaging program for account, support, waitlist, and product notifications. By submitting your mobile number through a form on our website or in the app and checking the SMS consent box, you agree to receive recurring text messages from Blood Health AI at the number provided, including messages sent via automated technology. Consent is not a condition of purchase or of using the Services. Message frequency varies based on your activity. Message and data rates may apply from your wireless carrier. You can opt out at any time by replying STOP, or reply HELP for help. We will never sell, rent, or share your mobile number or SMS opt-in data with any third party or affiliate for their own marketing purposes. 9. Limitation of liability
To the maximum extent permitted by law, Blood Health AI and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
The Services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
10. Indemnification
You agree to indemnify and hold harmless Blood Health AI from any claims, damages, losses, or expenses arising from your violation of these Terms or your misuse of the Services.
11. Termination
We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. You may also delete your account at any time through the app settings. Upon termination, your right to use the Services ceases immediately.
12. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in San Francisco, California, except that either party may seek injunctive relief in court.
13. Changes to these terms
We may revise these Terms from time to time. Material changes will be communicated via email or in-app notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
